You and HyperSphere agree that any dispute, claim, or controversy arising out of or relating in any way to HyperSphere's products or its Service shall be determined by binding arbitration in Los Angeles County, California, instead of in courts of general jurisdiction. You agree that, by agreeing to these Terms of Service, the U.S. Federal Arbitration Act governs the interpretation and enforcement of this provision, and that you and HyperSphere are each waiving the right to a trial by jury or to participate in a class action.
You further agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of our Service must be filed within one (1) year after such claim or cause of action arose or be forever barred.
You and HyperSphere further agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
